Committee of Adjustment Agendas, Staff Reports, Minutes and Decisions

 

Please be advised that the Comprehensive Zoning By-law is due to be considered at the upcoming Council meeting on September 24, 2025. Due to the approval process related to the Comprehensive Zoning By-law, there will be a direct impact on Minor Variances that would be heard on the September 11, 2025 and October 2, 2025 Committee of Adjustment meetings.

In light of the above, the Committee of Adjustment will only be hearing Consents (with no associated Minor Variances) at the September 11, 2025 meeting. The October 2, 2025 Committee of Adjustment meeting will be cancelled due to the impact of the appeal period from the Comprehensive Zoning By-law.

All Minor Variances previously scheduled for the September 11th and October 2nd meeting will be moved to the October 23rd Committee of Adjustment agenda, or to the subsequent scheduled meeting agendas.

Should you have any questions regarding the above, or regarding rescheduling an application, please do not hesitate to reach out to Committee staff.

 

Canada Post Labour Disruption Alert: 

Due to a possible Canada Post labour disruption, notices of upcoming Committee of Adjustment meetings may not be provided by standard mailing. Pursuant to the legislative requirements of the Planning Act, as amended, and as outlined in O.Regs 197/96 and 200/96, respectively, a Notice of Hearing may be provided by posting it, with the time and date of the meeting, on the City’s website.

What is the Committee of Adjustment?

The Committee of Adjustment (CoA) is an independent body comprising five (5) individuals: one (1) Chair and four (4) Members. They are appointed by Council and authorized under Section 44 of the Planning Act, R.S.O. 1990, c.P.13, as amended, to consider applications for Minor Variance and Consent.

Before you begin your application, please ensure you have the following:

  1. The zoning of your property. Please contact zoninginfo@richmondhill.ca if you require assistance in obtaining this information.
  2. The Official Plan designation of your property. Please contact planning@richmondhill.ca if you require assistance in obtaining this information.
  3. A sketch or survey plan (in metric) displaying the information included in your application form (you may submit additional sketches if all the information is not able to be provided on one plan). 
    • the true dimensions and boundaries of the property for which the application is being made (note: a sidewalk is not usually a lot line)
    • the location, size, and type (e.g., deck, single family dwelling etc.) of all existing buildings, structures or uses on the subject property, including setbacks measured from the front, rear and side lot lines.
    • the location, size, and type (e.g., covered porch, 2-unit dwelling, parking spaces, etc.) of all proposed buildings, structures or uses on the subject property, including setbacks measured from the front, rear and side lot lines.
    • all projections from buildings and structures, including but not limited to eaves and gutters, steps, fire escapes/exterior staircases etc.
    • location of all natural and artificial features on the subject land and on land that is adjacent to the subject land that may affect the application (e.g., railways, trees, wells, and septic tanks)
    • location, width, and name of any roads within or abutting the subject land.
    • location and nature of any easement affecting the subject land.
    • the information provided must be legible and drawn with good drafting techniques.
  4. Elevation Plans for all sides where new construction is proposed, indicating height, grade and window and door openings. Floor plans are not required as part of your application. 
  5. If your variance includes relief from parking requirements, a parking justification study is required.
  6. If there are any trees within six (6) metres of the proposed construction work, including trees located on adjacent properties, a Tree Inventory and Preservation Plan and Arborist Report are required. If any trees on the property line or adjacent lands are impacted, consent from the adjacent owner is required. Construction work includes, but is not limited to, any area used for the purposes of construction, grading and excavation, storage of construction materials or equipment, movement of machinery, paving, and demolition or replacement of structures.
  7. All registered owners of the property must sign the Authorization of Owner form linked above. Registered owners must have the form commissioned and submitted to the City, or contact Committee of Adjustment staff for an appointment, free of charge, at commiteeofadjustment@richmondhill.ca.
  8. Payment must be made at the time of online application. Please refer to the 2025 Tariffs of Fees By-law and the 2025 fees for Committee of Adjustment Applications.

 

NOTE: If a property is a listed or designated heritage property, a Cultural Heritage Impact Assessment (CHIA) may be required. Please contact the City’s Heritage Planner at heritageplanning@richmondhill.ca for details on what is to be included in the CHIA.

  3. All registered owners of the property must sign the form. Registered owners must have the form commissioned and submitted to the City or contact Committee Staff for an appointment, free of charge, at commiteeofadjustment@richmondhill.ca.
  4. Payment must be made at the time of online application. Please refer to the 2025 Tariffs of Fees By-law and the 2025 fees for Committee of Adjustment Applications.
  5. A sketch, plan or reference plan prepared by an Ontario Land Surveyor that includes: 
    • Property boundaries and dimensions of the intended severed and intended retained lands
    • Dimensions and boundaries of any land abutting the subject lands
    • The location of all land previously severed on the property
    • The approximate distance between the subject lands and the nearest City lot line or landmark (e.g. bridge, railway crossing)
    • The approximate location of all natural and artificial features (e.g. buildings, railways, roads, watercourses, drainage ditches, banks of rivers or streams, wetlands, wooded areas, trees, wells or septic tanks)
    • The current uses of the land that is adjacent to the subject property
    • The location, width and name of any roads within or abutting the subject lands (with indication of whether it is an unopened road allowance, public travelled road, private road or right-of-way)
    • The location and nature of any easement affecting the property
    • The location, size, and type of all existing or proposed buildings, structures or uses on the subject property, including setbacks measured from the front, rear, and side lot lines
  6. If there are any trees within six (6) metres of the proposed construction work, including trees located on adjacent properties, a Tree Inventory and Preservation Plan and Arborist Report are required.
