The Town of Richmond Hill's Fence By-law provides that rear and side yard fences may be erected to a maximum of 1.9 meters (6 feet) in height except in side yards that abut a street. Front yard fences may be erected to a maximum height of 1.2 meters (4 feet) except on corner properties. In the case of corner lots, a fence may not be built in the sight triangle so that it obscures the visibility of motorists and pedestrians.
Where a home owner is installing a swimming pool or any other self contained body of water exceeding 24 inches in depth, a pool enclosure is required as specified in the by-law. This includes above ground pools, decorative ponds, fish ponds and spas. Pool enclosures shall be a minimum height of 4 feet, 9 inches. The fence must be constructed in a manner so as to stop the accessibility of young persons. All gates must open into the yard area and be self closing, self latching with the latch being on the inside of the gate at a minimum height of 4 feet, 9 inches from grade. The latch must be inaccessible from the outside and be locked at all times when the pool is not in use.
Where a pool is going to be installed, the home owner must first obtain a permit from the Town's Building Division, located on the 4th floor of 225 East Beaver Creek Road during regular business hours. Please provide a copy of the property survey with a diagram of the location of the pool and where the enclosure will be located. Include all gates, accessory structures, pump house and any doors leading from the house into the pool area.
