Notice of Passing of Zoning By-Law
The Corporation of the City of Richmond Hill
Take notice that the Council of The Corporation of the City of Richmond Hill passed By-law 105-25 on October 29, 2025 under section 34 of the Planning Act, R. S. O. 1990.
And take notice that an appeal to the Ontario Land Tribunal (Tribunal) in respect of the Zoning By-law may be made by filing a written notice of appeal with the City Clerk of The Corporation of the City of Richmond Hill, no later than 4:30 p.m. on December 3, 2025.
An explanation of the purpose and effect of the Zoning By-law and map showing the location of the lands to which the amendment applies, is set out below. The amendment was processed under City files ZBLA-24-0009 and SUB-24-0003.
Council in making its decision on this matter took into consideration all written and oral comments received on the applications.
A Notice of Appeal must:
(a) set out the reasons for the appeal;
(b) be accompanied by the fee prescribed under the Ontario Land Tribunal Act in the amount of $1,100.00 payable by certified cheque or money order in Canadian funds to the Minister of Finance, Province of Ontario.
(c) be accompanied by the processing fee prescribed under the Tariff of Fees By-law in the amount of $351.00 payable by certified cheque or money order in Canadian funds to the City of Richmond Hill. Certified cheques are not required when the cheque is from a law firm; and
(d) be addressed to the City Clerk at the address noted below.
Who Can File an Appeal:
Any of the following may appeal to the Tribunal by filing with the clerk of the municipality a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by the fee charged by the Tribunal:
1. The applicant.
2. A specified person who, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
2.1 A public body that, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
2.2 The registered owner of any land to which the by-law would apply, if, before the by-law was passed, the owner made oral submissions at a public meeting or written submissions to the council.
3. The Minister.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Explanatory Note to By-law 105-25
By-law 105-25 affects lands located on the south side of Edgar Avenue and north side of Scott Drive, west of Yonge Street, legally described as Lot 8 and Part of Lot 9, Registered Plan 3852; and Lots 77 to 79, Registered Plan 1930, municipally known as 35, 37, 39, and 41 Edgar Avenue and 20 Scott Drive.
By-law 93-25, as amended of the City of Richmond Hill, allows a variety of land uses without the zone categories found in conventional land use by-laws.
By-law 105-25 will have the effect of rezoning the subject lands to "Neighbourhood Two (N2) Zone", "Neighbourhood Three (N3) Zone" and Neighbourhood Four (N4) Zone" under By-law 93-25, as amended. This application will facilitate the creation of nine (9) single detached lots and the extension of Clinton Drive.
