Notice of Passing of Zoning By-Law
The Corporation of the City of Richmond Hill
Take notice that the Council of The Corporation of the City of Richmond Hill passed By-law 71-25 on June 11, 2025 under section 34 of the Planning Act, R. S. O. 1990.
And take notice that an appeal to the Ontario Land Tribunal in respect of the Zoning By-law may be made by filing a written notice of appeal with the City Clerk of The Corporation of the City of Richmond Hill, no later than 4:30 p.m. on July 10, 2025.
An explanation of the purpose and effect of the Zoning By-law and map showing the location of the lands to which the amendment applies, is set out below. The amendment was processed under City file D02-19016.
Council in making its decision on this matter took into consideration all written and oral comments received on the applications.
A Notice of Appeal Will:
(a) set out the reasons for the appeal;
(b) be accompanied by the fee prescribed under the Ontario Land Tribunal Act in the amount of $1,100.00 payable by certified cheque or money order in Canadian funds to the Minister of Finance, Province of Ontario. Certified cheques are not required when the cheque is from a law firm;
(c) be accompanied by the processing fee prescribed under the Tariff of Fees By-law in the amount of $351.00 payable by certified cheque or money order in Canadian funds to the City of Richmond Hill. Certified cheques are not required when the cheque is from a law firm; and
(d) be addressed to the City Clerk at the address noted below.
Who Can File an Appeal:
If a specified person, public body or registered owner would otherwise have an ability to appeal the decision of the Council of the City of Richmond Hill to the Ontario Land Tribunal but the specified person, public body or registered owner does not make oral submissions at the public meeting or make written submissions to the Council of the City of Richmond Hill before the proposed Zoning By-law is passed, the specified person, public body or registered owner is not entitled to appeal the decision of City Council.
If a specified person, public body or registered owner does not make oral submissions at the public meeting, or make written submissions to the Council of the City of Richmond Hill before the proposed Zoning By-law is passed, the specified person, public body or registered owner may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Explanatory Note to By-law 71-25
By-law 71-25 affects the subject lands described as Part of Lot 52, Registered Plan 65R38393, Concession 1, W.Y.S., municipally known as 10920 Yonge Street.
By-law 30-25, as amended, of The Corporation of the City of Richmond Hill currently zones the subject lands "Yonge and Bernard Key Development Area (KDA-YB(H)) Zone". The intent of the Holding (H) symbol is to prohibit any development on the lot until specific requirements are met to the satisfaction of the City, including the retention of non-residential gross floor area. the submission of a Concept Plan related to phasing of development, the submission of a Transportation Planning Study and Transportation Demand Management Study, the submission of a Functional Servicing Report and the submission of an Arborist Report, Tree Inventory and Protection Plan, or Natural Heritage Evaluation.
The conditions with respect to the Yonge and Bernard Key Development Area (KDAYB(H)) Zone restrictions have been satisfied accordingly and By-law 71-25 has the effect of removing the Holding (H) symbol from the zoning of the lands.
