Notice of Refusal to Amend a Zoning By-law
Take Notice that the Council of The Corporation of the City of Richmond Hill made a decision to refuse the application by BH Properties Limited for a Zoning By-law Amendmenton June 24, 2020 under section 34 of the Planning Act, R. S. O. 1990.
And Take Notice that an appeal to the Local Planning Appeal Tribunal in respect of the Zoning By-law may be made by filing a written notice of appeal with the City Clerk of The Corporation of the City of Richmond Hill, no later than 4:30 p.m. on July 15, 2020.
Purpose & Effect: to amend the Zoning By-law to facilitate the creation of one additional single detached dwelling lot on the subject lands
Location: Lot 208, Plan M-37 and municipally known as 57 Beaufort Hills Road.
Reason For Refusal: Council refused the proposed application as it does not conform with the City’s Official Plan, specifically those policies related to intensification within neighbourhoods, the compatibility of development with the character of the adjacent and surrounding area, and the protection of significant woodlands.
Council in making its decision on this matter took into consideration all written and oral comments received on the applications.
A Notice of Appeal Will:
(a) set out the reasons for the appeal;
(b) be accompanied by the fee prescribed under the Local Planning Appeal Tribunal Act in the amount of $1,100.00 payable by certified cheque or money order in Canadian funds to the Minister of Finance, Province of Ontario. Certified cheques are not required when the cheque is from a law firm;
(c) be accompanied by the processing fee prescribed under the Tariff of Fees By-law in the amount of $310.00.00 payable by certified cheque or money order in Canadian funds to the City of Richmond Hill. Certified cheques are not required when the cheque is from a law firm; and
(d) be addressed to the City Clerk at the address noted below.
Who Can File An Appeal:
If a person or public body would otherwise have an ability to appeal the decision of the Council of the City of Richmond Hill to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at the public meeting or make written submissions to the City of Richmond Hill before the proposed Zoning By-law is passed, the person or public body is not entitled to appeal the decision of City Council.
If a person or public body does not make oral submissions at the public meeting, or make written submissions to the City of Richmond Hill before the proposed Zoning By-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
