Notice of Refusal to Proposed Official Plan and Zoning By-law Amendments
Take Notice that the Council of The Corporation of the City of Richmond Hill made a decision to refuse the applications by First Baymac Developments Limited for an Official Plan Amendment and Zoning By-law Amendment on July 6, 2022 under Sections 22 and 34 of the Planning Act, R. S. O. 1990.
And Take Notice that an appeal to the Ontario Land Tribunal in respect of the applications, may be made by filing a written notice of appeal with the City Clerk of The Corporation of the City of Richmond Hill, no later than 4:30 p.m. on August 11, 2022.
Purpose & Effect: a request for approval concerning an Official Plan and Zoning By-law Amendment applications to permit the construction of a nine storey retirement residence on the subject lands.
Location: Part of Lot 21 and municipally known as 1070 Major Mackenzie Drive East.
Reason For Refusal: Council refused the proposed applications as the proposed height and density is not appropriate for the site, the proximity Bayview Secondary School, the negative impacts of increased traffic and impacts on traffic safety, nonconformity with surrounding development and loss of retail and other commercial space.
Council in making its decision on this matter took into consideration all written and oral comments received on the applications.
A Notice of Appeal Will:
(a) set out the reasons for the appeal;
(b) be accompanied by the fee prescribed under the Ontario Land Tribunal Act in the amount of $1,100.00 payable by certified cheque or money order in Canadian funds to the Minister of Finance, Province of Ontario. Certified cheques are not required when the cheque is from a law firm;
(c) be accompanied by the processing fee prescribed under the Tariff of Fees By-law in the amount of $326.00 payable by certified cheque or money order in Canadian funds to the City of Richmond Hill. Certified cheques are not required when the cheque is from a law firm; and
(d) be addressed to the City Clerk at the address noted below.
Who Can File An Appeal:
A person or public body that requested an amendment to the official plan of the City of Richmond Hill and has requested an application for an amendment to the Zoning By-law has an ability to appeal the decision of the Council of the City of Richmond Hill to the Ontario Land Tribunal by filing a notice of appeal with the City Clerk. If a person or public body does not make oral submissions at the public meeting, or make written submissions to the City of Richmond Hill before the requested Official Plan Amendment and Zoning By-law Amendment were refused, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
